Divorce costs depends on whether or not the divorce proceeds on an unopposed basis (with a settlement agreement) or on an opposed basis. Unopposed divorces costs may vary between R15 000.00 and R20 000.00, whereas an opposed divorce can, over time, cost between R40 000.00 and a few hundred thousand rand.

An unopposed divorce can take up to 3 months, whereas an opposed divorce can take anything between 6 months to a few years to finalise, depending on the disputes between the parties.

A divorce action is started by way of one spouse issuing a summons at court against the other spouse, requesting the court to grant an order for a decree of divorce. The summons will then be personally served on your spouse by the sheriff, where your spouse will then have the option to either defend the divorce or to concede to the terms you requested. In an uncontested or mediated divorce, the parties can agree to enter into a settlement agreement before summons is issued.
